Just had a letter from CPS - anyone explain what this means...
... my house was burgled, police found DNA, slam dunk prosecution... said I wasn't needed at the trial... just got a letter from them which appears to say he was found guilty and later in the letter that he was found NOT guilty... can anyone legal advise what this means (yes I tried to phone CPS but it just goes to voicemail so I thought I'd try the font of all knowledge i.e. WHO)... my interpretation is the CPS couldn't do a mail merge properly and he was found not guilty due to a technicality as it was thrown out by the judge???

So, turns out the Police and CPS did screw up the prosecution.

I eventually got a call back from "witness support" at CPS would was incompetent. She couldn't tell me anything and couldn't understand the problem I had with the letter she had sent me until I pointed out it didn't make sense. Then she said she had made an error and it was indeed "not guilty".

She told me she couldn't tell me why case had been thrown out by the judge and couldn't ask anyone. Not a lot of "witness support" really then? I called CPS directly and they told me they couldn't tell me what happened but I'd be getting a letter... which I doubt will happen.

The Police eventually got back to me to explain that the CPS case was there was DNA in the item the bloke had dropped, he has a massive string of burglary convictions and therefore he is bang to rights m'lud or words to that effect. Half way through the trial the defence found the legal guidance on the burglary law which says finding DNA on an item brought into a property from outside is not sufficient evidence on its own, legally you need at least one other piece of evidence. His record doesn't count as evidence. So the judge threw it out.

How the fuck so the shitty CPS and Police not know the law? He many guilty people get cases thrown out through the system not working properly. How much does this incompetence cost us tax payers when trials are stopped?

Depressing.

The CPS use a template for their letters, so they just amend the relevant parts. Looks like something wasnt amended correctly.

Call the OIC (Officer in case), local CPS office or the court itself.

The prob with all those CSI type programs now is we are led to believe that once you have DNA it is an open and shut case. If you can raise doubt in the DNA then the case falls apart

You don't normally get the same probs with old fashioned fingerprints

He was found guilty by the jury but the judge subsequently directed the jury to return a not guilty verdict. Probably on a point of law such as incorrect procedure or a gap in the chain of evidence in respect of the way the DNA evidence was either obtained or processed.

This has got to be part of the greatest and most complex explanation to a wife of how a 50 year old Jamaican's DNA got onto the back of another man's pants.

And the fucking CPS sent me the email 5 hours ago and I responded within seconds and the cunts aren't picking up ever since.

If it was thrown out on technicality my guess would be the DNA was damaged/inconclusive therefore he couldnt be sentenced because of it

No, it doesn't C&P very well. Under "verdict" it says "Not guilty (by jury on judge's direction)"

His plea was also "not guilty". Given there was DNA evidence I don't understand what happened.

The CPS woman emailed me the letter at lunch time, I phoned her seconds after receiving the letter and no response to calls or emails. Hence I think they ####ed up and she just can't write a letter as well.
